Electronic Redemption Proceedings (EPU 3.0)

Electronic writ of payment (EPU) is an institution in the Polish judiciary, which was introduced on 1 January 2010 on the basis of the amendment to the Code of Civil Procedure and is regulated by the provisions of Chapter I, Section VIII of the Code of Civil Procedure. Thanks to the EPU, it is possible to pursue claims without the need to appear at hearings - to file a lawsuit, it is enough to log in to the e-court website. The e-court, i.e. the 6th Civil Division of the Lublin-West District Court in Lublin, is the only court in Poland adjudicating in cases brought via the Internet. For the e-court, the place of residence of the parties is not important, and a lawsuit can also be filed from countries other than Poland, provided that the place of residence or registered office of the parties (or at least the address for correspondence) are located in our country. In electronic writ-of-warranty proceedings, only pecuniary claims are asserted. A necessary condition is that the amount of the obligation must be set in a clear, explicit and comprehensible manner and that the obligation to pay must result directly from the documents indicated by the applicant (invoices, various types of contracts, bills or orders). Since there is no evidentiary procedure in the electronic writ of payment procedure, there should be no doubt as to the existence of an obligation on the part of the debtor to pay and, at the same time, to fail to comply with it. The claimant is not obliged to attach evidence to the application, he only needs to indicate it accurately describing it. Ongoing monitoring of the operation of the EPU 1.0 system and the results of the 2020 NIK audit on the implementation of IT projects aimed at improving the administration of justice (KPB.430.010.2020, No ewid.160/2020/P/19/038/KPB) made it possible to diagnose the key problems of the current EPU 1.0 system: 1) outdated technology on which the system was built, which does not give a chance for trouble-free further maintenance of the system, 2) failure to take into account all the needs of users using the system, in particular vulnerable groups, 3) lack of real possibilities to implement new and necessary functionalities, including the function of case symbolization, new forms, corresponding to the needs of internal users (judges, secretarial staff), but also external ones (court bailiffs, parties to proceedings, professional representatives or mass entities). The above problems are further complicated by frequent changes in the legal environment, forcing a hasty modification of the ICT system, due to the lack of a sufficiently long vacatio legis, as well as by an excessive burden on judges and referendaries of the e-court. As part of the EPU 3.0 project, the Ministry of Justice will design, build and implement a modern EPU 3.0 ICT system in a uniform, modern technology using a new system and hardware platform that will enable its effective operation, further development and provide access to justice for citizens. This system will ensure the technical feasibility of implementing the rules on electronic writ-of-warranty procedures. The new EPU 3.0 system will also respond to the above-mentioned diagnosed problems. All existing functionalities enabling handling in the EPU will be maintained, while eliminating all previously perceived defects of the EPU 1.0 and taking into account the currently applicable technical standards. It will be fed with data collected in the existing EPU 1.0 system (data migration) in a way that ensures continuity of access to files of pending and completed cases. The new data model will allow the recording of migrated data from the existing system, including in particular court files, while allowing the use of new system functionalities A necessary requirement for the new ICT system is a significant improvement in its efficiency and fluidity of operation due to the constantly increasing amount of resources.
