Development of the Solidarity Trade Union's capacity to actively participate in the monitoring and law-making process

The main tasks of NSZZ ‘Solidarność’ include representing workers’ interests in the face of changes in the economy and the labour market. The Union as a social partner (SP) should actively monitor the process of creating and implementing public law and policies so that they are adapted to the needs identified by the communities associated with the NSZZ "S". Undoubtedly, one of the most important manifestations of good social dialogue and the effectiveness of the PS is the conclusion of company and supra-company collective agreements (UPAs). In this area, Poland ranks last among the EU countries, with 13% of all employees covered by the SLA (according to OECD data, as of 2021). In this context, it is particularly important that the NSZZ ‘S’ prepares to implement into Polish law Directive (EU) 2022/2041 of the European Parliament and of the Council of 19 October 2022 on adequate minimum wages in the European Union, which entered into force on 14 November 2022, and whose provisions should be implemented by 15 November 2024, and which aims to increase the number of employees covered by collective agreements in all Member States where the scale of coverage is lower than 80%. The important collective role of professional associations has also been recognised and recognised at European level in the Revised European Social Charter (ESC) (adopted in 1996), which is currently the most progressive and modern international human rights treaty of the second generation. The Charter provides protection in areas such as equal treatment between men and women, the elimination of workplace risks, the rights of children and young people, vocational training of the unemployed and the reintegration of the long-term unemployed, dismissal conditions, the right to dignity at work, protection against social exclusion and poverty, and the right to housing. In addition, the Additional Protocol introduced a system of collective complaints that can be submitted by representative employers’ organisations, trade unions or non-governmental organisations. One of the goals written in Uchw. The Union's agenda is to seek ratification by Poland of this document, which is important from the point of view of human rights, and in particular social rights, which are the basis of dialogue and social order. Finally, Directive (EU) 2023/970 of the European Parliament and of the Council of 10 May 2023 on strengthening the application of the principle of equal pay for equal work or work of equal value between men and women through pay transparency and enforcement mechanisms is another fundamental element allowing social partners to make full use of social dialogue to build working conditions in which equal pay is reflected in the contractual provisions. In view of the above-mentioned existing documents of European law, action is needed to increase the ability of NSZZ‘S’ and its representatives to actively participate in the implementation of these documents into national legislation, as well as to create the conditions for increasing the number of agreements concluded and introducing solutions adequate to changes in the economy and work. In order to strengthen the involvement of structures in the law enforcement process, surveys conducted among the NSZZ "S" show that it is necessary to develop the expert potential of "S" in areas important for consultation, negotiation and collective bargaining, and to conduct systematic intra-union consultations, using active forms and modern consultation tools. The applicant undertakes to comply with the horizontal principles, including: the principles of equal opportunities and non-discrimination, including accessibility for persons with disabilities, equality between women and men, the principle of sustainable development.
